CONTRACT*

*This form is to be completed only after proper communication, consultation, and agreement with Onalee Rivera to assure your requested time and services are available.

Please read thoroughly, complete, sign, and email agreement and booking fee promptly.  Your date will not be held without a signed contract and paid booking fee.  A payment request will be sent to your email address for the booking fee.  The remainder must be paid the day of your event before any services begin. Please read the entire contract for detailed terms and conditions.

Services (check all that apply) *
Unless otherwise noted, each service requires about an hour for 10-15 guests. Therefore, adding additional services requires additional time booked.

TERMS & CONDITIONS
FEES *
PAYMENT TERMS: The balance agreed to in the contract, minus the booking fee, is due in cash on the day of the event prior to any services being rendered. All charges are due on the day of the event. Client must pay for the entire time booked even if Client uses Artist for less time. BOOKING FEE: Booking fee of $50 for 1 hour and 1.5 hour events or $100 for 2+ hour events is due via PayPal at least 2 weeks before event. Booking fee is non-refundable. SERVICES: $150 per hour for the first 2 hours. $100 per hour after the first 2 hours. Artist can service approximately 10-15 people per hour depending on the intricacy of the designs that are chosen. Be sure to book your time accordingly to avoid leaving anyone out. Client is responsible for turning away guests Artist cannot serve. BREAKS: Artist will have paid breaks of 5 - 10 minutes every two hours. OVERTIME: If Client exceeds the time booked and Artist is available to stay, time will be charged in half hour increments at $75 per half hour within the first 2 hours and $50 per half hour after the first 2 hours. Client will pay for the time booked plus overrun. TRAVEL: Travel fees apply when the event is outside of NYC’s five boroughs. Depending on your event, there may be a charge for outdoor, lengthy or difficult setup.
SETUP *
All setup options require access to a restroom, adequate lighting, and a place to dispose of painting water. For outdoor setups, Client is responsible to provide an alternate indoor location in the event of inclement weather such as storms and temperatures below 60 degrees or above 95 degrees. Client agrees to pay full amount contracted, even if inclement weather interrupts or cancels the event. Please do not place us next to generators, motors, or speakers. Indoor Setup: Client must provide a table and 2 chairs. Outdoor Setup - Option 1: Client must provide sun/wind/rain shelter (tree shade is not sufficient), table, and 2 chairs. *Outdoor Setup - Option 2: Artist can provide easy up shelter, table, and chairs for an additional charge of $50. Artist will need to set up 30 minutes prior to start / after completion of event in this case. This setup will require a minimum of 10’ L x 10’ W x 11’ H of level space.
CANCELLATIONS *
If the Client cancels the event, the booking fee is not refunded. If the event is rescheduled within 6 months, the booking fee will be credited toward the new event. If a cancellation occurs within 72 hours of the event start time, the payment for entire time booked is due in full. Should Artist become sick or have an emergency, the booking fee will be refunded and Artist will make every effort to find a replacement for your event.
LIMITATIONS ON ARTWORK *
Artist will not paint any place Artist does not feel comfortable painting. In addition, Artist will not paint or twist subject matter that Artist deems offensive or disturbing.
EXTREME ADVERSE WORKING CONDITIONS *
Artist has the right to cease work and leave if there are extreme adverse working conditions and the Client fails to remedy the situation after it has been brought to the Client’s attention. Adverse conditions include but not limited to: destructive, violent, or extreme inappropriate behavior of a child, pet, or adult; illegal activities; or otherwise dangerous conditions. Client agrees to pay full fee should adverse conditions occur, regardless of number of hours worked.
LIABILITY STATEMENT *
While Artist uses only cosmetic grade professional face painting supplies, Artist is not liable for allergic reactions to paint or other materials used. People with skin allergies or sensitive skin should either not participate, or have Artist perform a patch test at the beginning of the party. Client understands that some face paints will linger and must be removed with mild soap, water and washcloth. Artist will not paint anyone who is unwilling. For sanitary reasons, Artist will not paint anyone who is or appears to the Artist to be sick or suffering from cold sores, conjunctivitis, ringworm, sunburn, eczema, any infectious skin condition or open wounds. These determinations are at the Artist’s discretion. Artist will use reasonable care, but is not responsible for damage to clothing or property. The Client agrees to pay for any accidents or injuries caused by pets or guests, and/or damage to Artist’s equipment or supplies caused by pets, lawn sprinklers, or guests. Under no circumstances will Artist supervise children. Their behavior and safety is the Client’s and/or Parents’ responsibility.
